Effective date: July 10, 2026
Applies to: https://delvistaconsultants.net and https://delvistainspections.com
1. Acceptance
By accessing or using this website, you agree to these Terms and Conditions. If you do not agree, do not use the website. Separate proposals, service agreements, registrations, invoices, or platform terms may apply to particular services and control if they conflict with these website terms.
2. Company Services
We may provide special inspection, structural steel and welding inspection, testing coordination, WPS/PQR and welder-qualification consulting, technical consulting, and training or educational services. Service availability and scope may change. Website content is not a promise that a service will be available for a particular project, location, or date.
3. Quotes and Proposals
Quotes and proposals are based on information supplied by the client. Changes in scope, schedule, site conditions, access, specifications, or requirements may result in revised pricing or additional charges. Unless a written proposal states otherwise, it is valid for 30 days.
4. Scheduling and Site Readiness
Appointments depend on availability. Clients are responsible for safe and timely access, accurate project information, and ensuring that work is ready for the requested service. Delays, return visits, missed appointments, or expedited, after-hours, weekend, or holiday work may result in additional charges when disclosed in the applicable agreement.
5. Payment
Payment terms appear in the applicable proposal, invoice, service agreement, checkout page, or registration. Late or unpaid balances may result in suspension or cancellation of services and lawful collection activity.
6. Training
Training enrollment or completion does not guarantee certification, licensing, employment, examination success, or qualification by any code, standard, employer, or authority. Participants are responsible for prerequisites and requirements imposed by certifying bodies or governing authorities.
7. Website Information
Website information is provided for general informational and educational purposes. It may not reflect the latest code edition, project requirement, or professional standard and is not a substitute for project-specific advice or a written engagement.
8. Acceptable Use
You may not:
- Use the website for unlawful, fraudulent, or harmful activity.
- Attempt unauthorized access to any account, network, data, or system.
- Interfere with website security or operation or introduce malicious code.
- Scrape, copy, republish, or commercially exploit content except as expressly permitted.
- Misrepresent identity, affiliation, qualifications, or authority.
9. Intellectual Property
Unless stated otherwise, website text, graphics, logos, photographs, forms, reports, training materials, templates, and other original content belong to the Company or are used with permission. Limited personal or internal-business viewing does not transfer ownership or permit commercial reuse.
10. Third-Party Services
Links, embeds, payment tools, scheduling tools, maps, and other third-party services are provided for convenience. We do not control and are not responsible for their content, security, availability, terms, or privacy practices.
11. No Professional Relationship from Website Use
Viewing the website, sending an inquiry, or downloading general information does not create a client, engineering, legal, architectural, inspection, or other professional relationship. A professional relationship begins only through a separate accepted agreement or authorized engagement.
12. Disclaimers
To the fullest extent permitted by law, the website and its content are provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted availability. Rights that cannot lawfully be disclaimed remain unaffected.
13. Limitation of Liability
To the fullest extent permitted by law, the Company will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use. Liability for professional services is governed by the applicable written agreement. Nothing limits liability that cannot lawfully be limited.
14. Indemnification
To the extent permitted by law, you agree to defend and indemnify the Company from third-party claims arising from your unlawful use of the website, infringement of another party's rights, or violation of these terms.
15. Governing Law and Venue
California law governs these terms without regard to conflict-of-law rules. Any action relating solely to website use must be brought in a court of competent jurisdiction in the California county where the Company maintains its principal office, unless applicable law requires otherwise.
16. Severability and Waiver
If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver.
17. Changes
We may revise these terms by posting an updated version and effective date. Continued website use after posting constitutes acceptance of the revised terms to the extent permitted by law.
